3. Eligibility to Use Our Services

Our services are intended for businesses, retailers, tea house operators and adult buyers who are of legal age to enter into binding contracts in their own jurisdiction. By using our services, you confirm that you meet this requirement and that you have full authority to bind the organisation you represent.

Where you place an order on behalf of a company, a partnership or any other body, we treat you as acting with authority for that body, and both you and the body are jointly responsible for the order. We may ask for a business registration, a purchase order on letterhead or a similar document when we first open an account with a new partner.

We reserve the right to refuse service, cancel an order or request additional identity or authority verification at our discretion and without liability, particularly when we have reasonable doubts about a buyer capacity to complete a transaction under these terms.

4. Use of Our Website

5. Orders and Quotations

A quotation we provide is an invitation to place an order, not a guaranteed allocation of stock. Prices, volumes and delivery dates stated in a quotation remain valid for the period we indicate or, if none is stated, until we amend or withdraw them.

When you place an order, we will send a confirmation describing the goods, quantity, price and shipping instructions. A binding contract is formed when we issue that written confirmation, not earlier, and it is based on the particulars in the confirmation. Should you wish to change an order, we will do our best to accommodate the change before dispatch, but we cannot guarantee any modification once our packing line has begun.

For custom private-label runs, the confirmation also records the blend specification, the packing design and the batch identity that will travel with the goods. If the blend or artwork differs from what you approved, you may reject the consignment within the return window described in these terms.

6. Pricing and Payment

All prices stated in a quotation or confirmation are expressed in the currency shown and exclude any applicable taxes, duties or freight, which we always itemise clearly on your invoice. We reserve the right to correct any clear typographical errors in our published or quoted prices.

Unless we agree otherwise in writing, payment is due before dispatch. We accept the payment routes named on your invoice, and we will hold your order once funds are received and cleared. Overdue amounts may be subject to the late interest and recovery costs permitted by law, and we may pause further orders from the same buyer until the balance is settled.

All invoices are issued on the basis set out in the confirmation, and we cross out any figure that varies from the agreed price before sending the final statement. If a dispute arises about a specific line, you should raise it within the time allowed for payment while paying the undisputed remainder, so that the matter is isolated and resolved quickly.

7. Shipping and Delivery

We dispatch from our warehouse in the Qingyang District of Chengdu using the carriers named in your confirmation. Estimated delivery dates are provided in good faith and are not binding deadlines, since weather, customs and carrier schedules can vary beyond our control.

Risk of loss or damage to the goods passes to you at the point of delivery we state in the confirmation, normally when the goods are handed to the carrier, unless an agreement states otherwise. You are responsible for providing a correct delivery address and for arranging any import clearance and duties in your country, and we will assist with the shipping documents we are able to supply.

We pack every consignment to survive a hard journey, using sealed, moisture-resistant liners for loose leaf and secure corrugated boxes for ceramics and wares. If a carton arrives damaged or short, please note the exception on the carrier receipt and tell us within seven days, and we will investigate with the carrier and resolve the claim on your side.

8. Quality Grading and Acceptance

Before dispatch, every lot passes through our grading bench and is checked for leaf size, aroma, moisture and general condition against our published standards. The goods you receive will match the grade stated on your confirmation and the sample we provided, within the natural variation of an agricultural product.

Any complaint about quality, quantity or condition must be reported to us within seven days of receipt. We will review your claim against photographs, samples and our dispatch records, and where a claim is valid we will replace the goods or credit your account, at our discretion.

We encourage you to open and inspect a portion of each delivery promptly, because tea and botanicals are living products that respond to moisture, temperature and time. A lot that sits unopened for weeks before a complaint is harder to investigate, and we may ask for a sample from the unopened carton to verify that the original condition was preserved.

9. Returns and Refunds

Because tea and botanical products are perishable foodstuffs, we accept returns only for goods that are faulty, damaged on arrival or materially different from what you ordered. Returned goods must be in their original sealed packaging and unreopened, unless the reason for return is a defect in the packaging itself.

Approved refunds are issued to the original payment method within a reasonable period of the returned goods reaching us, in the manner and currency of the original payment. We do not charge a restocking fee for a valid claim.

Because our wholesale prices already carry a modest margin and because perishable goods cannot simply be returned to a shelf, we value a good relationship over profit on any single carton. Where a long-standing partner has an occasional difficulty, our team will work with you to find a fair outcome within the letter of these terms.

10. Intellectual Property

The KaiWeiTai brand, the content of this website, our catalogue copy, our grading standards text and all related materials are the property of Chengdu Kaiweitai Trading Co., Ltd. or its licensors. You may view and print pages for your own internal evaluation, but you may not copy, reproduce, distribute or republish our materials for commercial purposes without our written permission.

Nothing in these terms grants you any right, title or interest in our trademarks, trade names or copyright, and you must not use our branding to endorse or imply an affiliation with any independent product.

11. Privacy and Data

Our handling of any personal information you share with us is governed by our separate Privacy Policy, which forms part of these terms. Please read it together with this document, as it explains what data we hold, how we use it and what rights you have over it.

By placing an order, you consent to our processing of your details to complete that transaction, including the sharing of delivery data with carriers and customs authorities as described in the Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by law, Chengdu Kaiweitai Trading Co., Ltd. shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to the use of our website or the purchase of our goods.

Where liability cannot be excluded, our total aggregate liability to you for any claim arising from the supply of goods or services shall not exceed the amount you actually paid for the goods concerned in that transaction. Nothing in these terms limits liability that cannot lawfully be limited, such as liability for fraud or for death or personal injury caused by negligence.

13. Warranty Disclaimer

Our website and the information it contains are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose or non-infringement, to the fullest extent permitted by law.

Although we apply industry-standard grading to every lot, tea and botanicals are natural products whose appearance and aroma vary across seasons. We do not warrant that any particular result, such as a specific flavour profile or shelf life, will be achieved in your own brewing or blending conditions.

We therefore suggest that every buyer cup a sample of a new season lot before committing a full order to a blend or a menu. Samples are available at a fair price, credited back against a qualifying order, and our tasting notes accompany every sample box as a starting point for your own cupping.

14. Indemnity

You agree to indemnify and hold harmless Chengdu Kaiweitai Trading Co., Ltd., its officers, employees and partners from and against any claims, losses, damages, liabilities and expenses, including reasonable legal fees, arising from your use of our website, your breach of these terms, or your unlawful use of our goods.

This indemnity survives the termination of these terms and applies to claims brought by third parties as well as by regulatory bodies, subject always to the limits of applicable law.

15. Termination

We may suspend or terminate your access to our website or decline further orders if you breach any material term of this agreement, if you engage in conduct that threatens our staff, systems or other customers, or if required to do so by law.
